Welcome to Drom! These Terms and Conditions ("Terms") govern your use of the services, software, and websites (collectively, the "Service") provided by Drom ("we," "us," or "our").

By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

1. Description of Service Drom provides a conversational AI platform that enables businesses ("Clients") to create a digital version of their brand's expertise to engage with their end-users ("Customers") through automated conversations.

2. User Accounts To use the Service, you must register for an account. You agree to provide accurate, current, and complete information during the registration process. You are responsible for safeguarding your password and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

3. Client Content and Ownership

• Your Content: You retain all ownership rights to the information, data, text, and other materials you provide to the Service for the purpose of training your AI model (collectively, "Client Content").

• License to Us: You grant Drom a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and process your Client Content solely for the purpose of providing, maintaining, and improving the Service for you.

• Our Content: We retain all rights, title, and interest in and to the Service, including all underlying software, AI models, and technology, excluding your Client Content.

4. Acceptable Use You agree not to use the Service to:

• Violate any applicable laws or regulations.

• Infringe on the intellectual property or other rights of third parties.

• Transmit any harassing, defamatory, or obscene material.

• Transmit any viruses, malware, or other malicious code.

• Attempt to reverse-engineer, decompile, or otherwise discover the source code of the Service.

5. Fees and Payment You agree to pay all fees specified in your selected subscription plan. All fees are non-refundable, except as required by law. We reserve the right to change our prices and will notify you in advance of any fee changes.

6. Termination You may terminate your account at any time by contacting us. We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service will immediately cease.

7. Disclaimers and Limitation of Liability THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

IN NO EVENT WILL DROM BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY TO YOU FOR ANY AND ALL CLAIMS ARISING FROM THE USE OF THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

8. Governing Law These Terms shall be governed by the laws of the State of California, United States, without regard to its conflict of law principles.

9. Changes to Terms We reserve the right to modify these Terms at any time. We will provide notice of any significant changes. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.
